RELEASE AND WAIVER OF LIABILITY FOR ALL CLAIMS OF ANY TYPE OF DAMAGES OF PARTICIPANTS, PARENTS, GUARDIANS AND MINORS (Release and Waiver)

I hereby acknowledge and agree to the following terms and conditions before participating in any activities provided by Cube Events.

In consideration of being allowed to enter the play area, use playground equipment, participate in any party and/or program at Cube Events, I represent that I understand the nature of the activities and that I and the participant(s) identified below are qualified, in good health, and in proper physical condition to participate. I acknowledge that if I believe that conditions are unsafe, I will immediately discontinue my participation or the participation of the minor(s) in the activity and notify the employees of Cube Events.

I agree for myself and/or participant(s) undersigned that we shall comply with all stated and customary terms, posted safety signs, rules, and verbal instructions as conditions for play and participation in any party and/or program at Cube Events. Additionally, I agree that all undersigned and I shall use all equipment and items appropriately. Furthermore, I understand and agree that I will be solely responsible for any and all costs to repair or replace any damage to the facility and/or the equipment therein incurred by the undersigned's and my own negligent, reckless, or willful actions.

I recognize and understand that there are certain inherent risks associated with use of the play area, parties, programs, shows and activities that can involve the use of reduced and altered or theatrical lighting and special effects, and that risks of injury include, without limitation, physical and emotional injury, scrapes, bruises, cuts, the transmission of disease strains and allergic reactions through use of the Cube Events facility equipment or contact with other participants or surfaces they have contacted, and even more serious injuries, such as paralysis or death. Moreover, for myself and the participants undersigned below, I fully accept and agree to assume all of these risks (including risks arising from the negligence of other participants) and I assume full responsibility for personal injury to myself and the listed minor(s) and our respective heirs, assigns, administrators, personal representatives, and next of kin, waive, release and discharge Cube Events, its affiliates, owners, managers, officers, members, respective and collective agents, employees, volunteers, other participants, and sponsoring agencies for injury, loss or damage arising out of or related to our participation in any and all of Cube Events programs, activities, parties, and/or the use of the facilities of Cube Events. This waiver and release shall be binding and apply to all risks, known and unknown, even if resulting from negligent actions of other guests or employees of Cube Events.

I hereby release, discharge, and agree not to sue Cube Events, its respective administrators, owners, directors, agents, officers, employees, volunteers, sponsors, advertisers, and if any applicable owners and lessors of the premises on which activity takes place.

(Each considered “Releasees” herein from all liability, claims, demands, losses or damages)

This release and waiver extends to all acts of negligence by Cube Events and is intended to be as broad and inclusive as permitted by the law, and if any portion of this agreement is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

I, for myself, and the participant(s) undersigned, consent to the publication of personal pictures and recordings, which may be taken by Cube Events personnel and representatives, as well as our names. Publication may include, but is not limited to marketing materials, advertising, promoting and websites.

I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY AGREEMENT, FULLY UNDERSTAND ITS TERMS AS A LEGALLY BINDING CONTRACT AND UNDERSTAND THAT I HAVE GIVEN UP LEGAL RIGHTS FOR MYSELF AND THE PARTICIPANT(S) UNDERSIGNED BY SIGNING IT, FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT. FURTHERMORE, I ACKNOWLEDGE & AGREE THAT I WILL SUPERVISE ALL PARTICIPANT(S) UNDERSIGNED AT ALL TIMES AND CERTIFY THAT ALL OF THE BELOW PROVIDED INFORMATION IS TRUE AND CORRECT TO THE BEST OF MY KNOWLEDGE.
